What is Minor Guardianship in Wisconsin?
Minor guardianship in Wisconsin is a court-established legal relationship that allows a trusted adult — usually a grandparent, relative, or close family friend — to make daily decisions about a child’s healthcare, education, and safety when a parent cannot. Unlike adoption, it does not terminate parental rights.
That last part matters to a lot of families. Guardianship is not an ending. It is a way to keep a child safe and cared for while a family works through something hard, with the door to reunification still open.

How is guardianship different from foster care?
Foster care places a child in the custody of the county or tribe, which oversees the placement and provides ongoing case management. Guardianship gives a specific person legal authority over the child’s daily care, without that ongoing agency oversight. Foster parents are licensed and receive a monthly rate; guardians are appointed by a court and may or may not receive support depending on the type of guardianship.
Who can be a guardian in Wisconsin?
Any adult the court finds suitable can serve as a guardian — most often a grandparent, adult sibling, aunt or uncle, or a close family friend the child already knows and trusts. The court’s standard is the best interest of the child, so it looks at your relationship with the child, your ability to meet their needs, and your willingness to take on the role.
Do parents lose their rights under guardianship?
No. Guardianship does not terminate parental rights. Parents keep their legal relationship with their child and may still have contact, and guardianship can be ended if a parent’s circumstances change and the court finds it is in the child’s best interest.
